% 10.11.2016 By the present petition, the petitioner seeks quashing of FIR No.93/2014 under Section 135 of the Electricity Act registered at PS Palam Village and proceedings pursuant thereto as the parties have settled the matter.
Ms. Jaya Thakuria, Sr. Manager, Legal of respondent No.2 who is authorised and competent to make statement, is present in Court and identified by learned counsel. She states that though initially theft bill was raised for ₹311839.04p however respondent No.2 has settled the matter with the petitioner and bill for ₹125800/- was raised copy whereof is annexed as Annexure D to the petition which amount has been paid by the petitioner. She further states that since the petitioner has paid the settled amount, respondent No.2 does not wish to pursue the above noted FIR and
proceedings pursuant thereto.
Learned counsel for petitioners seeks exemption of the petitioners from appearing before this Court for the reason petitioner No.2 is an handicapped lady and petitioner No.1 who is his son has to look after her. For the reasons stated the petitioners are exempted from appearing before this Court.
Since the parties have settled the matter and no useful purpose will be served in continuing with the above noted proceedings and there is no legal impediment in quashing the above noted FIR, consequently, the FIR No.93/2014 under Section 135 of the Electricity Act registered at PS Palam Village and proceedings pursuant thereto are hereby quashed. Ms. Jaya Thakuria authorised representative of respondent No.2 has signed this order sheet in acknowledgment of her statement made before this Court Petition is disposed of.
