% 26.08.2016 In terms of the order dated 19.08.2016, the respondents have placed on record an affidavit stating that in the event of the appeal i.e. RCA No.11/2015 filed by the petitioner is decided in favour of the petitioner, the deponents/respondents shall refund the amount of Rs.10 lacs along with interest that the deponents would receive pursuant to the order of the trial court dated 02.08.2016.

The undertaking is taken on record. The respondents shall remain bound by the said undertaking.

The petition is disposed of with the direction that the parties shall remain bound by any order that may be passed by the appellate court. JAYANT NATH, J AUGUST 26, 2016 rb
