% 20.02.2019 Mr. Anand Prakash Bansal is the attorney of respondent nos. 2 and 3 and is present in court. Respondent no.4, namely, Ms. Payal Malik is also present in court. They are being represented by their counsel. They have been identified by SI Surendra Singh of police station South Campus. Mr.Anand Prakash Bansal and respondent no.4 submit that the matter has been settled between the petitioner and Private Respondents without any undue force, pressure or coercion. A photocopy of the settlement deed dated 17th July, 2017 has been placed on record as Annexure A-6. It is noted that a compromise decree has already been passed in
CS(OS) No.1572/2015 on 21.07.2017, titled as The Vishwa Nath and Santosh Bakshi Charitable Educational Trust (REGD.) & Anr. Vs. Santosh Kumari arora & Ors. pursuant to the settlement deed. A photocopy of the order has also been placed on record as Annexure P-7. Attorney of respondent nos.2 and 3 as well as respondent no.4 submit that they have no objection in case FIR no. 266/2015 under Sections 419/448/506/509/34 IPC registered at Police Station South Campus and consequent proceedings emanating therefrom are quashed against petitioners.
Keeping in mind the settlement arrived at between the petitioners and private respondents, which has even been accepted in the civil suit, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
