% 20.02.2019 Mr. Anand Prakash Bansal is the attorney of respondent nos. 2 and 3 and is present in court along with their counsel. They have been identified by SI Surendra Singh of police station South Campus. Mr.Bansal submits that the matter has been settled between the petitioners and private respondents voluntarily and without any undue force, pressure or coercion. A photocopy of the settlement deed dated 17.07.2017 has also been placed on record as Annexure A-6. Attorney further submits that a decree has also been passed in CS(OS) No.1572/2015 titled as The Vishwa Nath and Santosh Bakshi Charitable Educational Trust (REGD.) & Anr. Vs. Santosh Kumari arora &
Ors. on 21.07.2017, in terms of the settlement. A photocopy of the order has also been placed on record as Annexure P-7.
Mr.Bansal says that respondents have no objection in case FIR no. 97/2016 under Sections 420/467/468/471 IPC registered at Police Station South Campus and consequent proceedings emanating therefrom are quashed against petitioners.
Keeping in mind the settlement arrived at between the petitioners and private respondents voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
