The present petition has been filed under Section 482 Cr.P.C. seeking quashing of Complaint Case No. 17502/16 filed by the respondent under Section 138 of the Negotiable Instruments Act, 1881, which is pending trial. 2.

Learned counsel for the petitioner has assailed the impugned order on the ground that a settlement has been arrived at between the complainant/respondent and accused no. 2 i.e., the present petitioner only however the trial court has inadvertently mentioned that the settlement was with accused nos. 1 and 2.

In view of the above, the order dated 02.05.2018 is set aside and the matter is remanded back to the concerned Court for fresh consideration. The petitioner may make his aforesaid submissions before the trial court, which shall be considered by the Court in accordance with law. CRL.M.C. 4310/2018

Petition is disposed of in the above terms.
