% 07.09.2018 IA No.12070/2018 This application is filed under Order 23 Rule 3 CPC seeking to place on record the compromise between the parties. The terms and conditions of the settlement are stated in para 2 of the application. The terms and conditions of the agreement are legal and valid. Parties are bound by the terms and conditions of the settlement agreement. Application is disposed of.

CS(COMM) 1068/2018 In view of the above, a decree is passed in terms of the settlement as spelt out in para 2 of the application. The terms shall form part of the decreesheet. Suit and all pending applications, if any, also stand disposed of Interim order dated 10.08.2018 is modified in terms of the decree. Plaintiff shall also be entitled to refund of 50% of the Court Fee as per the provisions of the Court Fees Act, 1870.
