% 06.09.2018 Notice. Respondent no.2 Mr. Rishabh Tyagi is present in Court and accepts notice.
He has been identified by SI Sandeep of police station Crime Branch.
Respondent no.2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion. Respondent no. 2 further submits that he has received the entire settled amount of `7,00,000/- from the petitioners and is not willing to pursue the FIR No. 125/2017 under Sections 406/420/120-B IPC registered at Police Station Crime Branch any further. FIR is at the investigation stage.
There is only one complaint in the FIR. Investigating Officer says that no other written complaint has been received till date. Respondent no. 2 further submits that he has no objection in case FIR is quashed. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR, which is at the investigation stage, is quashed.
