% 10.08.2018 CM No. 32073/2018 Exemption allowed subject to all just exceptions. W.P.(C) 8360/2018 Span Naturopathy Wellness Resorts has filed the present writ petition stating that there is delay in disposal and pronouncement of order in IA No. 630/2016 and Appeal No. 455/2016. He has referred the orders which have been enclosed as annexure P-1.

We have also heard counsel for the Punjab National Bank, the second respondent in the present writ petition.

We would only observe that the Debts Recovery Appellate Tribunal would endeavour and dispose of the application and the appeal within a period of three months from 28th August, 2018, i.e. the next date fixed in the appeal. Liberty is, however, granted to the parties to file an application for

extension of time before the High Court if required and necessary. Parties will also not seek adjournment before the Debts Recovery Appellate Tribunal.

With the aforesaid directions and observations, the writ petition is disposed of. We clarify that we have not made any comments on merits. SANJIV KHANNA, J.
