The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.310/2014 registered under Sections 406/420/468/471 IPC at PS C.R.Park. Status report is on record. 2.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. The petitioner is in custody since 23.07.2016. Allegedly the complainant was cheated of `50 lacs on the pretext of selling land situated in Pathankot (Punjab) in 2011. It is alleged that the accused had already transferred his title in the said land way back in 2007. BAIL APPLN. 1729/2016

Reliance has been placed on compromise deed (annexure P3) whereby settlement took place between the parties. The petitioner placed on record receipt of `35 lacs (Page 36). The complainant denies to have received the payments though he admits his signatures on it.

As per this receipt, `10 lacs remain to be paid to the complainant.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the Trial Court subject to payment of `10 lacs to the complainant within a month through Investigating Officer by way of Demand Draft without prejudice and subject to future adjustment (if any). 5.

The bail application stands disposed of.
