O R D E R

% 14.01.2019 CM APPL. 541/2019 1.

This is an application filed on behalf of the petitioner seeking withdrawal of the present petition.

2.

It is seen that the averments made in the applications are highly disputed.

In view of the above, the prayers made cannot be granted. However, Mr Uppal, learned Senior Counsel appearing for the petitioner, on instructions, submits that the averments made in the said application be ignored and the petitioner be permitted to withdraw the present petition unconditionally.

3.

In view of the aforesaid statement, the petition is dismissed as withdrawn. However, it is seen that considerable time has been spent on this petition and this Court considers it apposite to impose costs quantified at ₹2,00,000/-. It is directed that ₹1,00,000/- shall be paid to Delhi High Court Bar Clerk's Association and ₹1,00,000/- shall be paid to the Delhi High Court Advocates Welfare Trust within a period of two weeks from today. 4.

It is clarified that this order will not, in any manner, affect the proceedings for perjury directed to be instituted under Section 340 Cr.P.C. in terms of the earlier orders passed by this Court. 5.

All applications are also disposed of as withdrawn. VIBHU BAKHRU, J JANUARY 14, 2019 RK
