% 27.04.2017 CM APPL. 15058/2015 Present application has been filed for revival of a disposed of contempt petition.

The petitioner who appears in person states that though his name has been brought in the select list of Assistants for the year 1985, yet he has been erroneously made the junior-most Assistant in the said Select List. Having heard the petitioner as well as having perused the papers, this Court finds that the Division Bench only directed that the petitioner was entitled to seniority in the cadre of Assistants w.e.f. 14th October, 1985. It did not stipulate that the petitioner would be the senior-most or junior-most in the cadre of Assistants w.e.f. 14th October, 1985.

At this stage, petitioner prays for liberty to challenge the order dated 10th July, 2015 passed by the Ministry of Communications and Information Technology, Department of Telecommunications. Consequently, present application is disposed of with liberty to the petitioner to challenge the aforesaid order dated 10th July, 2015 in accordance with law.
