O R D E R

% 26.04.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.1189/2015, under Sections 354(A)/509 IPC, registered at Police Station Uttam Nagar, Delhi, Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioner has submitted that petitioner and the respondent No.2 hails from the same nearby locality of Uttam Nagar and known to each other. Counsel further submits that due to a misunderstanding arisen between the parties, a quarrel had taken place between the parties which resulted into the registration of the aforesaid FIR against the present petitioner. Counsel further submits that the petitioner too got registered an FIR No.1563/2015, under Sections 354-A/354-C/354-D/509/34 IPC at Police Station Uttam Nagar, Delhi. Counsel further submits that after the registration of the aforesaid two FIRs, the near relatives and friends intervened and the misunderstanding was sorted out and the matter has been

amicably settled between the parties voluntarily and without any force, pressure or coercion and nothing remains to be adjudicated further between the parties, however, the FIR in question is coming as hurdle in the peaceful life of the present petitioner, and prays that the FIR and all proceedings arising therefrom may be quashed.

The respondent No.2/complainant Asha Sinha is present in the Court today and has been identified by the Investigating Officer, SI Naresh Kumar, P.S. Uttam Nagar, Delhi. The respondent No.2/complainant present in person admits that the matter has been amicably settled with the petitioner voluntarily and without any force, pressure or coercion. She further admits they reside in the same locality and are known to each other and nothing remains to be adjudicated further between the parties and further submits that she has no objection if the FIR in question is quashed.

Looking into the above facts and circumstances of the case since the matter has been amicably settled between the parties and nothing remains to be adjudicated further between the parties and, to have peace in the life of both the parties, I deem it appropriate to quash the aforesaid FIR and all proceedings arising from the same. Consequently, the FIR No.1189/2015, under Sections 354(A)/509 IPC, registered at Police Station Uttam Nagar, Delhi, Delhi and all the proceedings emanating therefrom are hereby quashed. Parties shall remain bound by the settlement. The present petition is disposed of accordingly. Copy of this order be given dasti.
