It has been pointed out on behalf of the Respondent that the preCharge evidence is already being recorded and the case is at the stage of arguments on Charge. It is also pointed out that while in the Arbitration proceedings no evidence per-se was recorded to show the forgery in the document but it was concluded on the basis of the surrounding circumstances, but in the Complaint Case the evidence has also been led of the Handwriting Expert to show that these documents were forged and fabricated.

At this stage, learned counsel appearing on behalf of the Petitioners, on instructions, seeks permission to withdraw these Petitions with liberty to raise all their contentions before the learned Trial Court. 3.

Learned counsel for the Petitioners, submits that the Petitioner being an old person, be allowed to appear through video-conferencing. No such directions can be given by this Court but the Petitioner is at liberty to move the appropriate application before the learned Trial Court for appearance through video-conference, which may be considered, in accordance with law. Learned counsel for the Petitioners further submits that the directions may be given to the learned Trial Court for expeditious disposal. 4.

The Petitions are permitted to be withdrawn with liberty as prayed for. 5.

The Petitions are disposed of accordingly. Pending Applications, if any, also stand disposed of.
