% 21.12.2016 None is present on behalf of the petitioner despite the matter being passed over once and called the second time.

We may also note that although this matter was being heard by a Single Bench and adjourned for 21.12.2016. But under the orders of Hon'ble the Chief Justice, matters pertaining to street vendors were to be listed before this Bench. Consequent to the directions of Hon'ble the Chief Justice, this matter is being listed since 9th December, 2016 before this Bench and has been on board.

None has been appearing in the matter. None appeared even on 20th December, 2016. The facts which led to the filing of the present writ petition are that the petitioner claimed to be squatting at the site situated at Gandhi Market opposite Lucky Juice Corner, RZ-E1, Sagar Pur, New Delhi. The grievance of the petitioner was that on 21st July, 2016 he was removed by the respondent No.1 in connivance with the respondent No.2. Respondent No.1 Delhi Urban Shelter Improvement Board had entered appearance on 24th August, 2016. Status report has been filed wherein the respondent No.1 has stated that at the site in question

a public toilet block has been erected. Ms.Pushkarna, learned counsel appearing on behalf of the respondent No.1, submits that the present writ petition thus has become infructuous.

Since none is appearing on behalf of the petitioner, the petition is dismissed for non-appearance.

However, we grant leave to the petitioner to approach the Town Vending Committee to redress his grievance. G.S.SISTANI, J.
