O R D E R

% 10.04.2017 I.A. No. 4150/2017 This application has jointly been moved by the parties under Order XXIII Rule 3 CPC to record their settlement. The application is signed by the parties and their respective counsel. It is also supported by the affidavit of Mr. Rajeev Saumitra, the Director and the authorised signatory of the plaintiff company and the affidavit of Mr. Bhagwati Prasad, the defendant in the suit. The compromise deed containing the settlement has been placed on record along with the application, which is also signed by the parties and the witnesses. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same.

It is stated by learned counsel, on instructions, that the parties have arrived at the settlement out of their own free will and accord and without there being any undue pressure or coercion.

Accordingly, the suit stands disposed of in terms of the settlement, which shall continue to bind the parties.
