The status report filed on behalf of respondent no.2 states that although the construction raised on property no. 1106 (Old No. 541), Ward No. 3, Gandhi Gali, Fatehpur, Delhi is unauthorised, it is protected under the National Capital Territory of Delhi Laws (Special Provisions) Second (Amendment) Act, 2014.

The photographs of the property in question filed along with the counter affidavit filed on behalf of respondent no.1 indicates that the construction in question is relatively a new construction. 4.

The petition is dismissed for non prosecution.

However, notwithstanding the same, respondent no.2 is directed to conduct an inquiry

as to when such construction was raised and take appropriate steps in accordance with law.
