CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 10.08.2018 Notice. Learned APP accepts notice for respondent no. 1 and says that Ikaram and Rashid have not been made parties to this petition. On the oral prayer made by the learned counsel for the petitioners, they are impleaded as respondent nos. 3 and 4. Amended memo of parties be filed during the course of the day.
Respondent nos. 2 to 4 are present in Court and accept notice. They have been identified by SI Virender of police station Zafrabad. Respondent no.2 submits that they have settled the matter with the petitioners of their
own free will and without any undue force, pressure or coercion. Respondent nos. 2 to 4 say that they have no objection in case FIR No. 260/2014 under Sections 308/34 IPC registered at Police Station Zafrabad and consequent proceedings emanating therefrom are quashed. Affidavits of respondent nos. 2 to 4 to this effect are also on record at pages 44-49. Keeping in mind the settlement arrived at between the petitioners and private respondents voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
