% 10.11.2017 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case, in as much as according to the FIR itself police had arrived at the spot on the day of incident and had apprehended three co-accused and petitioner was not arrested at the spot. As per FIR, accused-petitioner had fled the spot.

Role assigned to the petitioner is that he had hit the victim with a stone. Learned counsel for the petitioner submits that the victim sustained simple injuries and other co-accused have already been released on bail. Keeping in mind the totality of facts and circumstances, it is ordered that in case of arrest, petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.
