% 19.07.2017 Parties have settled the matter. Learned senior counsel for the plaintiff submits that the parties have settled the matter before the Delhi High Court Mediation and Conciliation Centre. Terms of settlement have been incorporated in para 6 of the report of the learned mediator dated 14th December, 2016 which is at pages 207 to 211 of the present paper book. Defendant No.2 was to pay a total sum of ₹3 crores to the plaintiff of which ₹2,25,00,000/- stands paid and the balance amount of ₹75,00,000/- has been handed-over to the plaintiff by learned counsel for the defendant CS(COMM) 1105/2016

today in court by way of demand draft No. '006724' dated 15th July, 2017 drawn on HDFC Bank. Leaned counsel for the defendant No.2 states that FIR No.446/2009 registered at PS Kadavanthra, Cochin has also been quashed by the High Court of Kerala.

The plaintiff who is present in Court and is identified by the learned counsel Ms. Poorvi Pant states that in view of the settlement arrived at between the parties before the Delhi High Court Mediation & Conciliation Centre on 14th December, 2016 and the defendant No.2 having acted thereupon, he does not press the suit any further in respect of his claims against defendants Nos.1 to 6 or for interest or damages. Plaintiff who is present in Court and is identified by the learned counsel seeks leave to withdraw the suit.

Plaintiff has signed the order sheet in acknowledgement of his statement made above.

Suit is dismissed as withdrawn.

In view of the fact that parties have entered into a settlement before Delhi High Court Mediation & Conciliation Centre the court fees be returned to the plaintiff in terms of Section 16 of the Court Fees Act, 1870. MUKTA GUPTA, J.
