O R D E R

% 22.08.2017 The petitioner seeks bail in anticipation of his arrest in connection with FIR No.514/2016 dated 17.12.2016 (PS Jyoti Nagar) instituted for the offence under section 307/34 of the IPC and section 27 of the Arms Act, 1959.

The allegation in the FIR is that the firing was resorted to by all the accused persons but it led to injuries on nobody. It has been submitted on behalf of the petitioner that the allegations in the FIR do not inspire confidence. If one person was targeted by three of the accused persons, it appears to be well-nigh impossible that he will not be hurt in the occurrence. Interim protection was granted to the petitioner to enable him to participate in the investigation. It has been submitted that the petitioner has been participating in the investigation. There also appears to be a disclosure statement of the co-accused Bholu that the arms which were used in the

occurrence were given to the petitioner for concealing them. The petitioner hails from the state of Himachal Pradesh. Taking into account the aforesaid facts, namely, the participation of the petitioner in the investigation and general and omnibus allegation of firing leading to injuries to no one, this Court is inclined to confirm the interim bail granted to the petitioner.

The petitioner, in the event of arrest or surrender, shall be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Trial Court. The petitioner shall keep on participating in the investigation and if it is reported that he has made any attempt to evade the process of investigation, it would be open for the police to file an application seeking cancellation of the anticipatory bail.

The application is disposed of.
