% 09.03.2018 The learned senior counsel for the petitioner, on instructions, submits that he may be allowed to presently withdraw the petition at hand and the applications filed therewith, questioning the correctness, legality and propriety of the order dated 18.07.2014, the petitioner reserving his right to raise the issue of limitation in the written statement and pressing it as a preliminary issue, requesting further that time may be granted for filing the written statement as the pleadings were not submitted on account of pendency of the present petition and the trial court record having been requisitioned here.

The learned counsel for the respondents, on being asked, submits no objection to the above said request.

The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. Copy of the order be given Dasti to both sides. R.K.GAUBA, J.
