Counsel for respondent no.3-school has brought to the attention of this Court that petitioner's claim for grant of ACP-II benefit was considered and rejected by the DPC of the respondent no.2-school on 14.3.2013. Copy of the Minutes of the DPC dated 14.3.2013 is placed on record, and copy of which has been given to the counsel for the petitioner. 2.

In view of the above position, the writ petition does not survive, and therefore, counsel for the petitioner prays for liberty to withdraw this writ petition so as to file appropriate independent proceedings to challenge

W.P.(C) 13956/2009 the decision of the DPC dated 14.3.2013 denying grant of ACP-II benefit to the petitioner.

Accordingly, this writ petition is disposed of as not pressed with liberty to the petitioner to challenge the decision of the DPC dated 14.3.2013, of course in accordance with law and the petitioner filing the sufficient pleadings as to how petitioner was qualified in terms of the relevant recruitment rules, scheme etc for being granted the ACP-II benefits. 4.
