% 23.08.2016 Crl.M.A. 13018/2016 Exemption allowed, subject to all just exceptions. Bail Appln. No.1728/2016 By this application, the petitioner seeks regular bail on merits though the medical treatment sheet of wife of petitioner is placed on record. Notice.

Learned APP for the State accepts notice.

Learned APP for the State submits that the trial is at the fag end. Learned counsel for the petitioner himself submits that all the witnesses have already been examined and the matter is listed for final arguments. Faced with this situation, learned counsel for the petitioner submits that the petitioner be granted interim bail for the reason his wife is unwell. A perusal of the document dated 8th August, 2016 issued by Panchsheel Nursing Home annexed as Annexure A2 to the paper book show that wife of the petitioner was admitted on 7th August, 2016 with gastritis, dehydration

and infection. The ailment being routine in nature, no interim bail can be granted for the reason the trial in Complaint Case No.412/2009 under Sections 452/376(2)(G)/506/34 IPC is at the fag end. Learned counsel for the petitioner states that despite the evidence having been concluded for last one year, final arguments have not been heard by the learned Trial Court and matter decided. Learned Trial Court is requested to expedite arguments and conclude trial as expeditiously as possible.

Petition is dismissed.
