% 10.10.2018 Learned counsel for petitioner submits that petitioner was known to the complainant as both were working in the same company. Petitioner was arrested and his disclosure statement was recorded. Complainant is witness to the arrest memo and subsequent disclosure statement of the petitioner.
Thus, TIP of petitioner is pointless. It is further contended that as per the FIR petitioner was in muffled face. For this reason also TIP has no value. Petitioner was arrested on 10th March, 2018, that is, after about five months of the incident in another case registered under the Arms Act.
Learned APP submits that petitioner has been identified in the TIP.
Offence alleged against him of robbery of more than `3 lac. Petitioner may not be released on bail.
Keeping in mind the totality of facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms.
