IN THE HIGH COURT OF DELHI AT NEW DELHI

+ RC.REV. 309/2017 & CM No.24159/2017 MOHD SHAKIR ..... Petitioner Through:

Mohd. Zahid, brother of petitioner.

versus MOHD NAZIM ..... Respondent Through:

None.

CORAM:

HON'BLE MR. JUSTICE R.K.GAUBA

O R D E R

% 15.03.2018 A person named Mohd. Zahid, elder brother of petitioner seeks adjournment on the ground his counsel is unwell and had to leave the court.

It is noted that almost identical submissions were made on 14.07.2017. No good ground for adjournment is made out. It is noted that the revision petition was filed challenging the order dated 17.01.2017 whereby leave to contest was granted to the respondent in the eviction case (E. No.206/15) of the petitioner seeking eviction on the ground of bona fide need. A perusal of record shows that the additional rent controller has granted the leave primarily for the reason that the petitioner had not disclosed the fact that a number of shops have been surrendered by his old tenants and also that he has a share in a commercial space of about 1200 sq. yards of property at Okhla.

RC.REV. 309/2017

In these circumstances, no error or infirmity is found in the impugned order.

The petition and the application filed therewith are dismissed. R.K.GAUBA, J MARCH 15, 2018 srb RC.REV. 309/2017
