% 24.01.2017 This is a petition for enforcement of an arbitral award dated 09.05.2016. Learned counsel for the respondent states that the said award has been challenged by way of a petition under Section 34 of the Act (OMP (COMM) No. 410/2016) which is now listed on 24.05.2017. In view of the decision of the Division Bench of this Court in FAO(OS) No.221/2016 (ARDEE Infrastructure Pvt. Ltd v. Ms. Anuradha Bhatia) the present petition is premature and is accordingly disposed of. Needless to mention that the petitioner is at liberty to file afresh subject to the outcome of the respondent's petition - OMP (COMM) No. 410/2016.
