% 29.1.2016 CM No.15012/2014 This application seeks modification of the order dated 3rd July, 2014. The Court had directed payment of user charges @ Rs.15,000/- per month from the date of the eviction order.

The applicant states that the said figure is a typographical error. Mr. Alok Sharma, the learned counsel for the non-applicant, supports the application. He agrees that the figure of Rs.15,000/- per month is a typographical error and instead it should read as Rs.11,000/- per month. It is so ordered. The amount payable from the date of the eviction order shall be Rs.11,000/- per month.

At this stage, Mr. Alok Sharma submits that the applicant was to have vacated the tenanted premises by 30.6.2015 but he has defaulted continuously.

Mr. Sonal Sinha, the learned counsel for the applicant submits, on instructions, that the applicant is ready and willing to vacate the premises and hand it over to the respondent, Ms. Shashi Aggarwal. However, in an execution petition, a third party has laid claim to the premises. He submits that, should there be no restraint by way of a Court order regarding the handing over of the premises to Ms. Shashi Aggarwal in any Court, the premises shall be handed over to Ms. Shashi Aggarwal by 29th February, 2016.
