O R D E R

% 12.02.2016 Present writ petition has been filed with the following prayers:- a) Issue a writ of certiorari or any other appropriate writ quashing the memo/letter dated 25th July, 2013 (annexure P-10) issued by the Respondent No.1/NCHMCT.

b) Issue a writ of certiorari or any other appropriate writ quashing the certificate date 13.8.2013 (annexure P-16) issued by the Respondent No.3/Institute.

c) Issue a Writ of certiorari or any other appropriate writ quashing Rule 20 of NCHMCT Examination Rules, 2001 (annexure P-11) d) Issue an appropriate writ or directions declaring the action of the respondents as illegal, unjust, unreasonable & arbitrary for not declaring the petitioner as „Pass‟ in B.Sc program in Hospitality and Hotel Administration (B.Sc in H & HA) being jointly offered by the Respondent No.1 and 2. e) Issue of writ of mandamus or any other appropriate writ or directions directing the Respondents to declare the Petitioner as „Pass‟ in B.Sc program in Hospitality and Hotel Administration (B.Sc in H & HA) and issue him a degree for the said course.

Today learned counsel for respondent no.1 has handed over a copy of letter dated 4th January, 2016 sent to him by respondent no.1. The relevant portion of the said letter reads as under:- " This is to inform that Mr.Nishant Parmar, Roll No.094657, a student of VELS Institute of Hotel Management - Chennai had appeared in the pending compartment paper of BHM205 - Food & Beverage Controls examination held on 18.11.2015 pertaining to Semester-III of 3-year B.Sc. in Hospitality & Hotel Administration during 20152016academic session. The student had cleared the subject and result declared.

In this connection, his 3rd year result which was withheld because of the pending paper is also being declared. The same has been informed to his institute i.e. VELS Institute of Hotel Management - Chennai.

The candidate is now eligible for award of degree." In view of the aforesaid letter, learned counsel for the petitioner does not wish to press the present writ petition. He however states that a time schedule be fixed for issuance of a degree to the petitioner. Keeping in view the aforesaid, the present writ petition is disposed of with a direction to the respondents to issue a degree to the petitioner within a period of six weeks.

With the aforesaid direction, the present writ petition stands disposed of.
