% 13.04.2017 Despite a pass over, none is present for the petitioner. Consequently, this Court has no other option, but to proceed ahead with the matter.
It is pertinent to mention that the present writ petition has been filed seeking a direction to the respondents No.2 and 4 to remove iron gates fixed opposite Vikas Bharti Public school on 12m R/W Cross Road (facing park side opposite Hanuman Mandir towards Vikas Bharti Public School), Pocket-12, Sector-24, Rohini, Delhi-110085.
It has been alleged that respondent No.4-RWA has erected iron gates
on both the ends of Cross Road without following due process of law and without obtaining consent in accordance with the Circular dated 25th June, 2007 issued by the Additional Commissioner (Engineering), MCD. Today, learned counsel for respondent-DDA states that the iron gates in question have been removed. He has handed over photographs showing that the gates stand removed. The said photographs are taken on record. Learned counsel for respondent No.4-RWA states that his client has applied for permission for installation of the gates. Keeping in view the aforesaid present writ petition and application are disposed of as satisfied.
