versus STATE OF NCT OF DELHI & ANR ..... Respondents Through:

Mr. G.M. Farooqui, APP for the State with SI Dharmender, P.S. Shahdara.

Mr. Vishnu Sharma, Adv. for R-2 along with R-2 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 07.07.2017 Petitioner no. 2 is father of petitioner no.1; whereas respondent no.2 is brother-in-law (wife's brother) of the petitioner no.1. On account of marital discord between the petitioner no.1 and his wife, that is, sister of respondent no.2, a quarrel appears to had taken place between the petitioners and respondent no.2, which led to registration of present FIR under Sections 324/506/34 IPC at police station Shahadra, on the complaint of respondent no.2.

Learned APP submits that Section 354-D IPC was added later on during the investigation, inasmuch as, charge-sheet has been filed under Section 324/506/354-D/34 IPC.

It is submitted that petitioner no.1 and his wife have already settled their disputes amicably before the Mediation Centre, Karkardooma Courts,

Delhi, inasmuch as, their marriage has also been dissolved by a decree of divorce. Now, petitioners and respondent no.2 have also settled their disputes, therefore, it is prayed that FIR may be quashed. Respondent no.2 is present in Court and has been identified by SI Dharmender of police station Shahadra. Respondent no.2 submits that he has settled the matter of his own free will and without any undue force, pressure or coercion. He further submits that he is not willing to pursue the FIR any further in view of the settlement and the same may be quashed.

In the totality of the facts and circumstances of the case as detailed above, FIR No. 91/2015 under Sections 324/506/354-D/34 IPC and the consequent proceedings emanating therefrom are quashed in view of the settlement.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
