% 06.10.2016 IA.12550/2016(under Order XXIII Rule 3 CPC) Plaintiff has filed the present suit for permanent injunction seeking restraint from infringement of plaintiff‟s marks under the Trade Marks Act, 1999, passing off, damages, rendition of accounts of profits, costs etc, against the defendants.
Present application IA No. 12550/2016 has been filed by the parties under Order 23, Rule-3 for recording the terms of settlement. The application is marked as Exhibit P-1. The application is signed by the parties, their counsels and supported by the affidavits of the authorised representative of the plaintiff and the sole proprietor of the defendant. I have heard the counsel for the parties and perused the application for settlement. The terms of the settlement are lawful. Accordingly, as prayed, the present suit is decreed in terms of Exhibit P-1. The settlement application and the Annexure A marked as P-2 shall form part of the decree.
The application also stands disposed of.
IA Nos. 7859/2015, (under Order XXXIX Rules 1 & 2 CPC) & 11428/2015 (under Order XXXIX Rule 4 CPC) In view of the suit having been decreed, the applications stand disposed of.
