This suit was settled between the plaintiff and the defendant nos.2 and 3 in terms of an earlier settlement agreement dated 11.4.2017 entered into between plaintiff and defendant nos.2 and 3 before the Delhi High Court Mediation & Conciliation Centre, and accordingly qua defendant nos.2 and 3 the suit was disposed of in terms of the settlement agreement dated 11.4.2017 by the order dated 13.4.2017 passed in the suit. 2.
Now it is stated that plaintiff and defendant no.1 have also settled the matter in terms of the settlement agreement dated 16.10.2017 CS(COMM) No.1117/2016
entered into between the plaintiff and defendant no.1 before the Delhi High Court Mediation & Conciliation Centre.

Accordingly, this suit is decreed in terms of the settlement agreement dated 16.10.2017, and which will form a decree between the plaintiff and defendant no.1.

Suit is accordingly disposed of.

In view of the fact that suit stands settled before recording of evidence, plaintiff will be entitled to refund of 50% of the court fee and accordingly let the Registry issue the necessary certificate of 50% of the court fee in favour of the plaintiff.
