By the present writ petition, petitioner prays for a writ of mandamus seeking a direction for cancellation of the order dated 7th August, 2014. Petitioner also seeks a direction to the respondent to consider his representation. The petitioner was working as a Court Attendant on co-terminus basis with a Judge of this Court. The services of the petitioner came to an end on 28th February, 2014. On the last date of hearing, counsel for the petitioner has submitted that identically placed Court Attendants have been permitted to continue working till a final decision is taken by the Full Court, while he has been singled out. Counsel for the petitioner has also submitted that the petitioner is willing to submit an undertaking that he will not claim back wages and will remain bound by the decision of the Full Court. adjourned to enable the respondent to seek instructions. 2.

Mr. Sanjay Ghose, learned counsel for the respondent, on instructions, submits that upon filing of such undertaking the petitioner will be permitted to function and work as a Court Attendant till a final decision is taken by the Full Court on this issue.

Accordingly, in view of the stand taken by the counsel for the respondent, the petitioner shall join his duties from Monday i.e., 14.9.2015. Undertaking be filed within five days from today.

The petition stands disposed of in the above terms. Order dasti.
