% 05.09.2016 Crl.M.A. 13070/2016 Exemption allowed subject to just exceptions. CRL.M.C. 3036/2016 & Crl.M.A. 13069/2016 (stay) By the present petition, the Petitioners seek quashing of FIR No. 72/2016 under Section 135 of the Indian Electricity Act registered at PS Sarita Vihar, Delhi on the complaint of Respondent No.2 on the ground that the bill amount has been paid and the parties have settled the matter. Notice. Learned APP for the State accepts notice. Notice is accepted by the learned counsel for the respondent No.2. CRL.M.C. 3036/2016

Authorized representative of respondent No.2 is present in Court and is identified by the learned counsel. She states that as a one time settlement parties have arrived at a settlement and there is no due remaining against the petitioner. Respondent No.2 does not wish to pursue the above-noted FIR and the proceedings pursuant to the settlement. Considering the fact that parties have settled the matter no useful purpose will be served in proceeding with the above-noted FIR and the proceedings pursuant thereto and there is no legal impediment in quashing the FIR, I deem it fit to quash the above-noted FIR and the proceedings pursuant thereto.

Consequently, FIR No. 72/2016 under Section 135 of the Indian Electricity Act registered at PS Sarita Vihar, Delhi and proceedings pursuant thereto are hereby quashed.

Authorized representative of the respondent No.2 who is identified by the learned counsel has signed the order sheet in acknowledgement of her statement made before this Court.
