O R D E R

% 01.11.2018 This petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') has been filed by the petitioner seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the Work Order dated 06.07.2016 as amended vide amendment dated 01.12.2016 placed by the respondent on the petitioner. The said Work Order contains an Arbitration Agreement in form of Clause 29 thereof.

Disputes having arisen between the parties the petitioner invoked the Arbitration Agreement vide its notice dated 25.05.2018. Having failed to receive any response, the present petition was filed. Though the respondent has filed a reply denying the receipt of the notice invoking Arbitration Agreement, the learned counsel for the respondent submits that the respondent has no objection if an Arbitrator is appointed by this Court.

At the request of the counsels for the parties, the parties are referred to the Delhi International Arbitration Centre (DIAC) where they shall appear on 19th November, 2018 at 2:00 p.m. DIAC shall appoint a Sole Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the above mentioned Work Order. The arbitration proceedings and fee shall be governed by the DIAC rules.

The petition is disposed of with the above directions, with no order as to cost.
