O R D E R

% 17.09.2018 CM No. 37946/2018 (early hearing) This Court vide order dated 4th September, 2018, passed in 8574/2018, titled as 'Praveen Jain vs. East Delhi Municipal Corporation' has directed that, this Court has no jurisdiction to grant the relief of desealing of the subject property and the same is a matter of challenge before the Appellate Tribunal of MCD.

In view of the circumstance that, the present writ petition is covered on all fours by the said decision and for the reasons stated in the application, the present application under Section 151 of the Code of Civil Procedure, 1908, seeking early hearing is allowed. The hearing of the writ petition is advanced to today.

The application is disposed of accordingly.

W.P.(C) 8671/2018 Learned counsel appearing on behalf of the petitioner, seeks leave to withdraw this petition, with liberty to file a statutory appeal before the Appellate Tribunal of MCD, in the first instance, in this regard.

Leave and liberty granted.
