% 27.09.2016 Present writ petition has been filed seeking a direction to the respondent-DDA to allot an alternative shop to the petitioner in lieu of shop No.10, Mall Road, Delhi, which had been acquired and demolished by the respondent under the Re-development Scheme of Kingsway Camp, Delhi.
Today Mr.Ashish Mohan, learned counsel for the petitioner states that he would be satisfied if the present writ petition is treated as a representation and disposed of in accordance with law after giving an opportunity of hearing to the petitioner. Mr.Arun Birbal, learned counsel for the respondent-DDA has no objection to the same. A perusal of the paper book reveals that despite making number of representations and petitioner's case being approved by the ViceChancellor, DDA on 20th March, 2015, petitioner has not been allotted an alternative shop till date.
Consequently, the present writ petition is directed to be treated as a representation to be decided by the Commissioner (Lands), DDA within a period of six weeks after giving an opportunity of hearing to the petitioner. The reasoned order shall be communicated to the petitioner by registered AD post.
With the aforesaid directions, present writ petition and the applications stand disposed of.
