CORAM:
HON'BLE MR. JUSTICE MANMOHAN
O R D E R
% 29.08.2016 Present writ petition has been filed seeking stay of functioning of a crematorium at Aruna Asaf Ali Marg, New Delhi. The petitioner, which is an autonomous institution under the Department of Biotechnology, Ministry of Science and Technology, Government of India, is aggrieved by the establishment of a crematorium within the Sanjay Van near Vasant Kunj being developed at a distance of 40 mtrs. from the campus of petitioner's institute.
Learned counsel for petitioner states that setting up of an open to sky crematorium close to human habitation besides adversely affecting the research activities, is a gross violation of human rights and right to life as burning of bodies leads to high pollution.
A perusal of the paper book reveals that the petitioner's representation to DDA as well as to the Lt.Governor of Delhi have not been disposed of till date.
Accordingly, the present writ petition is disposed of with a direction to the Hon'ble Lt.Governor of Delhi to dispose of petitioner's representation dated 27th July, 2016 within a period of two weeks.
In the event, the petitioner makes a representation to the concerned Commissioner of Municipal Corporation of Delhi, the same is also directed to be disposed of within a fortnight of receipt of the representation.
With the aforesaid directions, present writ petition and the application are disposed of.
Order dasti.
