% 11.01.2018 In this appeal, since 14th December, 2016, learned counsel for the Appellant has not been appearing or made any submissions. On a few occasions, the proxy counsel sought adjournments on the ground that the arguing counsel is unable to appear. On 19th October, 2016, learned counsel for the Appellant sought time to seek instructions, if his client is willing to vacate the suit premises, if granted reasonable time. Till date, the said instructions have not been obtained. No one appears for the Appellant on 16th August, 2017 and on 23rd November, 2017. Today also, none appears for the Appellant. The matter was passed over in the morning and even on the second call, there is no appearance for the Appellant. In this view of the matter, the present appeal is dismissed for non prosecution.
