After arguments were advanced in this second appeal, the learned senior counsel for the appellants, on instructions from the Advocate on record as also the appellant no.3 Sh. Davender Kumar Sharma who is present in Court states that this second appeal be disposed of as not pressed as the appellants want to take advantage of a recent policy for conversion of expired leases of the respondent/defendant for seeking rights in the suit land, and for which purpose appropriate proceedings will be initiated by the appellants.
This Court clarifies that this court is not making any observations on the merits of the claim now sought to be urged on behalf of
the appellants and I am only recording the statement made on behalf of the appellants and whether at all such a stand can be a valid basis for grant of reliefs, would only be decided by the concerned court before whom appropriate proceedings would be filed by the appellants which the appellants proposed to file.

Learned counsel for the respondent states that the stand now urged on behalf of the appellants is not valid, but I have already stated above that this Court has not expressed any view on the merits of the claim now sought to be raised by the appellants and respondent obviously will have all entitlement to defend any such claim which may be initiated by the appellants.
