% 26.08.2016 Petitioner is aggrieved by the fact that unauthorised and illegal construction has been permitted at property bearing no.A-48, Jagdamba Colony, Tunda Nagar, Gali No.1, Johri Pur, Delhi. This construction has been allegedly carried out by the private respondent namely respondent no.4.

On advance notice, learned counsel for the respondent/East Delhi Municipal Corporation has put in appearance. Status report has been placed on record. It is stated that the property was inspected on 22.8.2016. The property compromises of ground floor with projection of front street. The property has been booked on the same

date. The plot itself falls in unauthorized colony. A show cause notice has been issued to the owner/builder as to why action under Sections 343 and 344 of the DMC Act be not taken. Learned counsel for the respondent no.1 under instructions states that all actions in accordance with law will be taken and the illegal deviation in the aforenoted property will be taken to their logical conclusion. This undertaking of learned counsel for respondent no.1 is taken on record.

It is expected and to be ensured that the respondent will taken actions in accordance with law. If necessary, assistance of respondent no.3 shall be taken.

No further orders are called for in this petition. Petition disposed of.
