CM Appl.No.53441 and 53443/2018 CM No.53441/2018 is moved by the petitioner/applicant for modifying/clarifying the order dated 23.03.2018 passed by this Court in this matter and another CM No.53443/2018 is for delay condonation of 165 days.

The learned counsel for the petitioner/applicant says that in compliance of the dated 23.03.2018 the petitioner had paid the user charges as per the market rate and since revision petition filed by the applicant / tenant was allowed by this Court and leave was granted to contest the eviction petition such user charges be directed to be refunded, less the actual rental, to the petitioner herein.

Issue notice to the respondent through all modes returnable on 19.03.2019. Additionally, dasti notice through the learned counsel for respondent as appearing before the learned Trial Court. YOGESH KHANNA, J.
