W.P.(C) 3408/2017 The petitioner impugns the action of the respondents, whereby, the passport of the petitioner has been revoked under Section 10(9) and 12(1)(c) of the Passports Act, 1967. The petitioner also seeks a mandamus to the respondents to restore the citizenship of the petitioner.
The petitioner was a citizen of India. However, on taking up employment in Macedonia, the petitioner acquired the citizenship of Macedonia in the year 2015.
The respondents revoked the passport of the petitioner on the ground that, in terms of Section 9 of the Citizenship Act, 1955, the WP(C) 3408/2017
Indian citizenship of the petitioner was automatically terminated. The petitioner has resigned from his employment in Macedonia. Learned counsel for the petitioner submits that the petitioner wishes to give up the Macedonian citizenship and wishes to reacquire the citizenship of India.
Learned counsel for the respondents submits that, for the said purpose, the petitioner would need to make an application under Section 5(1)(f) of the Citizenship Act, 1955 alongwith the necessary compliances.
Learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file an application in terms of Section 5(1)(f) of the Citizenship Act.
The writ petition is dismissed as withdrawn with liberty to the petitioner to file an appropriate application under the Citizenship Act with the respondent No.1.
