This suit, instituted in the Principal Court of City Civil & Sessions Judge, Bangalore pending as OS No.0003240/2014 in the Court of CCH32, Additional City Civil and Sessions Judge at Bangalore, was transferred to this Court vide order dated 25th January, 2017 of the Supreme Court in Transfer Petition (Civil) No.1436/2014.

The suit was listed first before this Court on 19th April, 2017 when none appeared for either of the parties. Resultantly, court notice was ordered to be issued to the parties as also through counsels, for 25th August, 2017. 3.

The order dated 25th August, 2017 records that the defendants no.1 to 5 had been served and defendant no.5 Ravindra Kumar appeared in person on that date. The defendant no.5 appearing in person on 25th August, 2017 handed over a copy of the death certificate of Surendra Kumar Parachuri (giving the date of death of 30th October, 2016) who had instituted the present suit as the Managing Partner of M/s Paruchuri Global Financial Services.

Vide order dated 25th August, 2017 court notice was again ordered to be issued to the plaintiff as well to Sh. M. Vinod of Vinod Kumar Associates, Advocates and Solicitors at Bangalore who had filed the suit on behalf of the plaintiff.

The office report on the order sheet dated 15th November, 2017 records that as per the report on the process issued Mr. M. Vinod Kumar, Advocate, the said Advocate stated that his ex-client Surendra Kumar died on 30th October, 2016 at Bangalore in a shootout and he does not have any wife and children.

None appears for either of the parties today. 7.

Dismissed in default.
