% 09.03.2017 In these connected matters being called out, none appears for either side. It is noted that two applications under Section 151 CPC (IA 669/2011) and the other under Order XXIII Rule 3 CPC (IA 15516/2016) had come up in the context of CS (OS) 2505/2009 before CS(OS) 2505/2009, 782/2010 & 783/2010

the court on 15.12.2016 and 17.02.2017. In terms of the order passed on the record of the said civil suit on 17.02.2017, the said case was directed to be notified for 16.05.2017, awaiting application as indicated by the learned counsel on both sides to be moved. No such application has been moved till date.

It is noted that the list of 'finals' part B mentions against CS (OS) 782/2010 and CS (OS) 783/2010 that those cases are to be listed before the Joint Registrar on 16.05.2017. It appears that there is no order directing these cases to be listed before the Joint Registrar on such date.

Since all these three cases are connected, in terms of order dated 17.02.2017, they would need to be taken up in the court on 16.05.2017. It shall accordingly be listed under the category of 'directions' in the court on 16.05.2017. It is, however, clarified that they shall retain their position in the list of 'finals'.
