This writ petition purports to have been filed in public interest making extremely general assertions regarding mentally depressed persons. There are no details in terms of either the number or the nature of the ailments of such persons.

A prayer is made by the writ petitioner to detain the mentally depressed persons in rehabilitation centres to enabling them to earn their livelihood; development of re-settlement hostels and houses for rehabilitation and occupation; marketing of products manufactured by such persons in by the Central Government requirement. 3.

The writ petitioner has arrayed the Ministry of Health as the

respondent, whereas, the subject matter would be under the consideration of the Ministry of Social Justice and Empowerment. 4.

Be that as it may, the prayer in the writ petition is premised on extremely vague and general assertions without any reference to the other existing statutory provisions including the Mental Health Act, Lunacy Act, Guardian & Wards Act or the other Civil Schemes as the Code of Criminal Procedure cannot be entertained.
