Plaintiff and defendant in this suit for partition of property bearing No.C-255, Defence Colony, New Delhi were referred to Mediation Cell of this Court.

Mediation has been successful with the efforts of Mr.Puneet Taneja, Advocate/Mediator.

3.

A settlement agreement/MOU dated 01.06.2016 signed by the plaintiff and the defendant as well as their Advocates and the Mediator has been received from the Mediation Cell of this Court. 4.

Counsel for the plaintiff and counsel for the defendant also support the settlement and state that the suit be decreed in terms of the settlement thereof.

The suit is for partition and decree if passed would entail payment of stamp duty on the decree.

Attention of the counsels has been drawn to the said fact. It has further been informed that else the disposal of the suit will not result in any executable order/decree.

The counsels state that they do not require the decree to be passed and seek disposal in terms of the compromise arrived at between them.

8.

Accordingly the suit is disposed of recording the settlement and leaving the parties to bear their own costs and with the clarification that the decree is not to be drawn up and hence this order will not be executable.

9.

The date 26.10.2016, date fixed before Court stands cancelled. RAJIV SAHAI ENDLAW, J.
