% 15.09.2016 Marital discord between petitioner no.1 (husband) and respondent no.2 (wife) has led to registration of present FIR No.133/2014 under Sections 498A/406/3 IPC at police station Ghazi Pur. Petitioner no.1 and respondent no.2 have settled their disputes before the mediation centre, Karkardooma Courts, Delhi.
Marriage between petitioner no.1 and respondent no.2 has already been dissolved by decree of divorce dated 28th April, 2016 by mutual consent by Family Courts, Vishwas Nagar, Delhi. Respondent no.2 is present in Court and has been identified by SI Indrapal Singh, CAW Cell, East District. Respondent no.2 admits having received the entire settled amount. She submits that she has no objection in case the
present FIR is quashed.
Keeping in mind the settlement arrived at between petitioner no.1 and respondent no.2 before the mediation centre and that their marriage has already been dissolved by decree of divorce, the present FIR No.133/2014 under Sections 498A/406/3 IPC registered at police station Ghazi Pur and consequent proceedings emanating therefrom are quashed. Writ petition is disposed of in the above terms. Passport of the petitioner be returned to him by the Investigating Officer within one week. A.K. PATHAK, J.
