W.P.(CRL) 1130/2017 The present writ petition seeking quashing of the FIR No.130/2017 dated 30.03.2017 (P.S. Vasant Vihar) instituted for offences under Sections 354/354A/506/34 of the IPC has been filed on the strength of settlement having been arrived at with respondent no.2. The respondent no.2 is present in court today and resiles from her earlier statement regarding her consent for the quashing of the FIR.

Learned counsel for the petitioner draws the attention of this court to

the affidavit of respondent no.2 wherein she had earlier agreed to settle the dispute.

However, considering the stand of respondent no.2 today in court, learned counsel for the petitioner seeks to withdraw this petition in order to enable him to file a fresh petition at an appropriate time, either challenging the lodging of the FIR on merits or otherwise. Dismissed as withdrawn.
