O R D E R

% 05.04.2018 Learned APP submits that respondent no. 3-K.K. Anand is neither complainant/injured nor accused in this case, therefore, he is neither necessary nor proper party to the petition. Learned counsel for the petitioner submits that name of respondent no.3 may be deleted from the array of parties. Ordered accordingly. Amended memo of parties be filed during course of the day.

It is submitted that petitioner and respondent no.2 have settled their disputes amicably vide Compromise Deed dated 28th July, 2016, therefore, FIR No. 337/2016 under Sections 406/354/509/506/34 IPC registered at

police station K.N. Katju Marg may be quashed. Respondent no.2 is present in Court along with his counsel and has been identified by SI Virender Kumar of police station K.N. Katju Marg. Respondent no. 2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion. She has no objection in case FIR is quashed in view of the settlement.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
